Terms and Conditions
I. GeneralThe applicable prices are based on the price list of Weinstein Finewine – Mag. Spiegel Sebastian. Prices are subject to change due to exchange rate fluctuations or printing errors. Prices include the legally required value-added tax (VAT).
For reservations for a wine tasting in one of our wine bars, we kindly ask you to arrive on time. Otherwise, we will assign the tables to other guests after 15 minutes. Should the number of reserved guests change, or should a cancellation be necessary, we ask that you communicate this at least 12 hours in advance. We reserve the right to charge 50% of the total amount of the tasting for so-called "no-shows."
If the vintage of a wine is sold out in the meantime, the subsequent vintage will be sent automatically, even if this has not yet been updated on the product page.
II. Offers
Our offers are non-binding; the latest offer supersedes all previous offers. Due to limited quantities of individual vintages, items may sell out during your order process. Availability is subject to change! We reserve the right to reduce orders without providing reasons in order to allow all customers the opportunity to purchase our wines. Only our current delivery and payment terms apply to deliveries. Deviating agreements are only valid if confirmed by us in writing.
III. Due Date
The order is validly concluded upon our confirmation of the order (via email, telephone, or letter). In the event of spelling, printing, or calculation errors on the website, www.weinstein-finewine.com is entitled to withdraw from the contract.
IV. Delivery & Shipping
For information regarding shipping costs, please refer to "Shipping Details" on our homepage.
The following applies to deliveries within Austria and to Germany: For orders with a value of € 150.00 or more, there are no shipping costs within Austria and to Germany. For deliveries to other countries, we ask you to inquire in advance and contact us via email (cheers(a)weinstein-finewine.com).
V. Transport Damage
Transport costs and all risks transfer to the buyer upon departure from the Dornbirn warehouse. In accordance with international customs, we do not provide replacements for individual corked wines.
VI. Retention of Title
The goods remain the property of Mag. Sebastian Spiegel - Weinstein Finewine, Dornbirn, until full payment of all our claims (including any interest and costs) has been received.
VII. Prices
Prices are in Euros, per bottle, including all statutory duties and taxes for customers in Austria. Stated prices refer to previous sales prices. For delivery addresses outside of Austria, price changes may occur due to different taxes and duties.
The prices do not include any costs incurred during shipping. Prices and text are subject to typesetting and printing errors. Offers are subject to availability while stocks last.
VIII. Right of Withdrawal
If you are a consumer within the meaning of the Consumer Protection Act and have placed your order via distance selling by mail, telephone, fax, email, or via our online shop www.clubweinstein.com, you may withdraw from the concluded contract or a submitted contractual declaration within 14 days (Saturdays, Sundays, and public holidays are included in the period) without stating reasons in text form (e.g., letter, fax, email) or by returning the goods. The period begins at the earliest upon receipt of the goods by you or an authorized third party. Timely dispatch of the withdrawal or the goods is sufficient to meet the deadline.

Consequences of withdrawal:
If you withdraw from this contract, we shall reimburse all payments received from you, including delivery costs, with the exception of any additional costs resulting from your choice of a delivery method other than the cheapest standard delivery offered by Weinstein Finewine, without undue delay and at the latest within fourteen days from the day on which we received the notification of your withdrawal from this contract. We will use the same payment method for this repayment that you used for the original transaction unless expressly agreed otherwise with you. Under no circumstances will you be charged any fees for this repayment. Weinstein Finewine may withhold reimbursement until the goods have been returned to Weinstein Finewine in Dornbirn or until you have provided proof that you have sent back the goods, whichever is the earliest. You must send back or hand over the goods to Weinstein Finewine, Weppach 1c, 6850 Dornbirn, Austria, without undue delay and in any case no later than fourteen days from the day on which you notify Weinstein Finewine of your withdrawal from this contract. The deadline is met if you send the goods before the expiry of the fourteen-day period. You bear the direct costs and the risk of returning the goods. You are only liable for any loss in value of the goods if this loss in value is due to handling that is not necessary for checking the condition, characteristics, and functioning of the goods.
IX. Warranties
In accordance with international customs, no replacement can be provided for corked wines. Unwanted goods may be returned at the buyer's expense within 3 months, provided they have not been opened. The sale of alcoholic beverages is only permitted to persons over 18 years of age. Any invalidity of individual provisions does not affect the validity of the remaining provisions.
X. Place of Jurisdiction
The place of performance is Feldkirch. For all legal disputes, the contracting parties submit to the jurisdiction of the District Court of Feldkirch, regardless of the amount in dispute.
